The medieval guild of type-setters probably sent similar letters to the NYTimes in the past. The new wrinkle is that I bet this was robo-signed.

Ms. Kendra Goldenberg needs to remember the old saw "Any publicity is good publicity."

It appears that her legal position is that all media, including TV should cease reporting on the NYSE as a named entity. Maybe the media should take her up on the offer.

TV, radio, print, and Internet would cease to mention or show NYSE or New York Stock Exchange. Instead, it would just become a generic "trading floor" or "traders". TV would cease to broadcast from the floor or with it as background in a feed.

Their PR department could then pay the media, typically by running 30-second spots or print adds, for any specific mention of the NYSE. I am sure that the the PR department and their budget setters would enjoy that experience immensely. However, it would likely mean additional revenues for the media business, especially print media, that have been struggling; so overall it would likely be of benefit to society.

Perhaps this is just the mentality of another lawyer, but I would do more than just publish the C&D. Letters like this amount are not based on any good faith extension of existing law. They are frivolous; they abuse the system. In such circumstances, they are actionable on their own, in civil court and also in the State Bar.

Until someone not only takes a punch, but hits back, this nonsense will continue.
