Dream job or snake pit? UN appoints new spokesman

It’s not uncommon for journalists at some point in their careers to cross the barricades and become the people who dish out the news as spokespersons for an organization or firm, rather than being on the receiving end. It requires a different set of skills that can make the transition tough, and a stern test confronts former Reuters correspondent Martin Nesirky, who has just been appointed spokesman for U.N. Secretary-General Ban Ki-moon. After a high-flying career at Reuters that saw him fill senior editorial positions in London, Berlin, Moscow and Seoul, Nesirky has had some time to acclimatize to his new role by working for more than three years as spokesman for the 56-nation Organization for Security and Cooperation in Europe (OSCE), based in Vienna. But the move to New York brings much more formidable challenges.

Like any U.N. spokesperson, Nesirky, a Briton, will have to take into account the concerns of the 192 nations that belong to the world body. That’s 192 different governments that can get upset by something he might say. But his chief problem may be his boss Ban, whose public image, to put it mildly, could take a little burnishing. Aside from his awkward use of English, which has television producers tearing their hair, Ban has had a rough ride from hostile media that have accused him of failing to use his position to end the world’s conflicts and right its wrongs. (Defenders say he is more effective than he appears, works tirelessly behind closed doors, and has made at least some progress on such intractable issues as climate change, global poverty and the crisis in Darfur.)

Then there is the sprawling and ill-defined nature of the U.N. press and public relations operation, with different officials and factions competing for the secretary-general’s attention and waiting to pounce on any mis-step by one of the others. The outgoing spokeswoman, Michele Montas of Haiti, stuck to the job for less than three years. In trying to stay close to the South Korean secretary-general, Nesirky could benefit from his knowledge of the Korean language from his time in Seoul. He is also married to a South Korean. But these advantages too could be a double-edged sword. U.N. diplomats have long complained that Ban is happiest in a Korean comfort zone and relies too much on a compatriot who serves as his deputy chief-of-staff, Kim Won-soo.

As a white male from a Western permanent member of the Security Council, Nesirky could also face suspicion from diversity lobbies and from the developing world, which already sees Ban as too much in thrall to the United States. (Ban’s U.S. critics make the opposite accusation.)

In the world of spokespeople, the U.N. post may look from the outside like a dream job. But insiders were not so envious. Nesirky joins the world body as Ban is getting ready to try to persuade the great powers who decide these things that he has done well enough in his first five-year term of office, which ends in December 2011, that he deserves a second one. Most analysts give him a good chance, saying he has done nothing to offend key players in Washington and Beijing. But if they are wrong, Nesirky’s job could turn out to be one of his shorter assignments.

Norwegian memo sparks PR crisis for UN’s Ban Ki-moon

Ban Ki-moon isn’t having a good year for public relations. Halfway through a five-year term as U.N. secretary-general, he’s been hit with a wave of negative assessments by the Financial Times, The Economist, London Times, Foreign Policy and other media organizations. In a March 2009 editorial entitled “Whereabouts Unknown,” the Times said Ban was “virtually inaudible” on pressing issues of international security and “ineffectual” on climate change, the one issue that Ban claims he has made the biggest difference on. The Economist gave him a mixed report card, assigning him two out of 10 points for his management skills while praising him on climate change (eight out of 10 points).
    
This week, Norway’s Aftenposten newspaper made an unpleasant situation much worse. It published a confidential memo assessing Ban’s 2-1/2 years in office from Oslo’s deputy U.N. ambassador, Mona Juul, to the Norwegian Foreign Ministry. Juul’s report is scathing — and it comes from a representative of one of the world’s body’s top financial contributors. She says the former South Korean foreign minister suffers from a “lack of charisma” and has “constant temper tantrums” in his offices on the 38th floor of the United Nations building in midtown Manhattan.
    
She describes Ban as a “powerless observer” during the fighting in Sri Lanka earlier this year when thousands of civilians were killed as government forces ended a 25-year civil war against Tamil Tiger rebels, trapping them on a narrow strip of coast in the country’s northeast. In Darfur, Somalia, Pakistan, Zimbabwe and Congo, she wrote, Ban’s “passive and not very committed appeals seem to fall on deaf ears.” She says that his recent trip to Myanmar was a failure and that some people in Washington refer to Ban as a “one-term” secretary-general.
    
Juul’s letter could hardly have come at a more inopportune time. Ban is planning to visit Norway in the coming weeks, where he intends to meet with government officials and visit the Arctic circle to see for himself the effects of global warming and the melting polar ice. Now U.N. officials fear reporters will be more interested in what he says about Juul’s memo than climate change.

So far Ban has not reacted to the letter. However, a Norwegian diplomat told Reuters that Ban’s press office had been instructed to hold off on confirming his visit to Norway shortly after the news of Juul’s memo began to spread.
    
Ban’s PR difficulties didn’t start this year. In March 2008, his chief of staff Vijay Nambiar sent a memo to U.N. employees explaining how to say his boss’s name. “Many world leaders, some of whom are well acquainted with the Secretary-General, still use his first name mistakenly as his surname and address him wrongly as Mr. Ki-moon or Mr. Moon,” Nambiar complained.
 
Then came Ban’s own speech to senior U.N. officials in Turin, Italy last year, in which he described how difficult it was to improve the working culture inside the United Nations. The secretary-general seemed to acknowledge that his internal management style had failed. “I tried to lead by example,” Ban said. “Nobody followed.”
    
Ban’s aides vehemently defend him, saying he’s being treated unfairly by the press. One senior U.N. official suggested privately that Ban could very well turn out to be “the greatest secretary-general ever.” They complain that people continue to compare him to his predecessor Kofi Annan, who was a very different U.N. chief and relied less on “quiet diplomacy” than Ban. Annan became a hero to many people around the world for standing up to the administration of former U.S. President George W. Bush over the U.S.-led invasion of Iraq. Annan called the March 2003 invasion illegal. U.N. officials also complain bitterly about the indefatigable blogger Matthew Lee, whose website Inner City Press regularly accuses Ban and other U.N. officials of hypocrisy and failing to keep their promises to reform the United Nations and root out corruption. (Some U.N. officials accuse Lee of not always getting his facts right, but his blog has become unofficial required reading for U.N. staffers around the world.)
    
Australian Prime Minister Kevin Rudd, diplomats in New York say, is among those supporting a campaign against a second term for Ban. Juul’s memo said Helen Clark, New Zealand’s former prime minister and current head of the U.N. Development Program, “could quickly become a competitor for Ban’s second term.” But diplomats say they expect the United States, Britain and other major powers to reluctantly back a second term for Ban, if only because there appears to be no viable alternative whom Russia and China would support.
    
A recent article in the Times of London said the best U.N. chief in the organization’s 64-year history was not Swedish Nobel Peace Prize laureate Dag Hammarskjold but the Peruvian diplomat Javier Perez de Cuellar, who held the top U.N. post for 10 years until 1992. Nicknamed “mumbles” because he was so difficult to understand, Perez de Cuellar kept a low profile and, like Ban, preferred backroom diplomacy, not Annan’s bully pulpit. Among the Peruvian diplomat’s successes were managing the end of the Cold War, leading a long-delayed revival of U.N. peacekeeping and encouraging member states to back a U.S.-led military operation to drive Iraq’s invading forces out of Kuwait in 1991.
    
Will Ban’s preference for quiet diplomacy make him as good or better than Perez de Cuellar? That remains to be seen.

The cash cost of war

We often hear of the human cost of war. We don't often see the cash cost laid out so baldly as in the price list that went with my colleague Abdi Sheikh's feature from Mogadishu on the arms market that thrives in the city amid Somalia's tragedy.

Among popular weapons, a 120 mm mortar costs $700, plus $55 for each mortar bomb. A 23 mm anti-aircraft gun (truck mounted), fetches a hefty $20,000.

Pistols range from $400 to $1,000 according to condition and country of origin. An Indian-made AK-47 Kalashnikov assault rifle costs $140. Better quality versions from North Korea cost $600 and the Russian original costs $400. Hand-grenades go for $25 each, landmines $100.

Huge weapons systems, such as nuclear missiles, are the stuff of international geopolitics. But in Africa at least, the weapons that are killing people on a daily basis in places like Somalia, the Democratic Republic of Congo and Darfur are more modest in scale and can be bought at a relatively low cost.

Are the Palestinians getting a hearing at the UN racism conference?

Although the U.N.’s racism conference in Geneva has been dominated by Middle East politics, Palestinian rights groups say Palestinians have effectively been silenced.On the one hand tough rules by the conference organisers prevented Palestinian NGOs from holding “side events”, they say. On the other hand Monday’s controversial speech by Iranian President Mahmoud Ahmadinejad, slamming Israel as a “totally racist government” founded “on the pretext of Jewish suffering”, has distracted attention from the issues that actually affect Palestinians.

 

  “One thing that we have noticed in this conference is that there has been a concerted effort to silence the voices of the Palestinian presence and raising the Palestinian issue,” said Wisam Ahmad of Al-Haq, a Ramallah-based advocacy group.

 Ahmad says that Ahmadinejad’s speech became the symbol of the conference, as intended by “those that wanted this conference to fail”.

 “We as Palestinians want to be heard and it is unfortunate that the press attributes the statements of the president of Iran to all of the Palestinian people,” he said.

 

Ingrid Jaradat, director of the Badil Resource Center in Bethlehem, agrees.

 “We all knew he was going to come, we all knew that the European governments were going to wait until they just hear the key word and then they will all stand up and leave the hall and then the press comes in, they all would write about what he said or did not say and everybody would forget what is really written in the documents and what the conference is really about,” she said.

  “From my point of view I do not think that this was helpful for the Palestinian people in general and not for our organisation.”

 Diplomatic manoeuvering in the run-up to the conference, known as Durban II, resulted in references to the Palestinian question being dropped from the draft declaration, in an effort to get all U.N. members to take part.

 

In the event the United States, Israel and half a dozen other countries decided to stay away. European states walked out of Ahmadinejad’s speech but most came back for the rest of the conference, which agreed a final declaration on Tuesday.

 That document “reaffirms” the Durban Declaration and Programme of Action (DDPA) agreed in 2001, which does refer to Israel and the Palestine territories.

 It was that reaffirmation that prompted the United States to stay away this time. The U.S. and Israel walked out of the 2001 meeting following attempts, subsequently dropped, to equate Zionism with racism in the final document.

 

The 2001 meeting was marred by anti-Semitic demonstrations and activities by some non-governmental organizations (NGOs) that led Jewish groups to warn that Durban II – the review meeting in Geneva – could be another “hatefest”.

 This time conference organisers put strict limits on what NGOs could organise on the sidelines of the meeting. Such side events had to deal with “thematic” questions such as the treatment of immigrants, not individual countries.

 

As a result Palestinian rights groups found their requests to hold events dealing with Palestine issues were rejected.

 (A pro-Israel group did manage to hold an event at the U.N. during the conference, apparently by circumventing the conference organisers and booking a room directly through the U.N. offices.)

 

Critics of the U.N. human rights process say it spends a disproportionate amount of time on the Israel/Palestine issue.

 For example, since its creation three years ago, the U.N. Human Rights Council has devoted five of its 10 special sessions to Israel and its alleged human rights violations in the occupied Palestinian territories and Lebanon. (One each examined the financial crisis, Congo, the food crisis, Myanmar and Darfur.)

 “The real victims of the hijacking of the human rights agenda to focus on Israel are not Israel. Israel is a strong country. It can defend itself, it has articulate spokespeople to defend it,” said civil rights activist and Harvard University law professor Alan Dershowitz.

 “While the people of Rwanda were being murdered the U.N. was debating Israel. While the people of Darfur were being murdered the U.N. was debating Israel. While the people of Cambodia were being murdered the U.N. was debating Israel,” he said.

 

And Palestinians acknowledge that they have little to show for all the diplomatic focus on their problems. Even though the 2001 document refers to the plight of the Palestinians under occupation, little has changed.

 “So far the Durban declaration and programme of action has not really succeeded to bring about any major change or improvement in the situation of the Palestinian people but in fact our situation has very much deteriorated since 2001,” said Jaradat.

Will Bashir warrant worsen war?

Sudan’s President Omar Hassan al-Bashir has seen off other challenges in almost 20 years in power and there is no sign that he is going to give in to the arrest warrant issued by the International Criminal Court for war crimes and crimes against humanity in Darfur.

Some supporters of the court's move hope it will eventually persuade Sudan's politicians to hand over their leader in a palace coup, end the festering conflict in Darfur and do more to repair relations with the West.

But many signs point in the other direction, turning Bashir further towards allies such as Russia and China as he strengthens his hold on power.

Some believe the court’s decision could worsen the fighting in Darfur because rebel movements will be emboldened and because Khartoum will feel that there is no longer any point in trying to pander to the West.

There are also concerns over what it could mean for the 2005 peace deal that ended the two-decade north-south war - although officials from the semi-autonomous south have been quick to say, in public at least, that they are standing behind Bashir.

While Bashir remains in power, the arrest warrant means the West has lost one of its strongest negotiating cards with Sudan -- the offer to normalise relations.

The new U.S. administration could still offer Sudan the carrot of removing the country from its list of state sponsors of terrorism. But early statements from President Barack Obama and his team suggest they plan a tougher stance on Sudan.

Some of the 30 African countries who signed the founding statute of the International Criminal Court may start reconsidering their involvement. Many states already feel the court's investigations to date have unfairly targeted the continent.

And there is no sign that Bashir will be arrested. Despite the call from the ICC for all countries to implement the warrant, he plans to go to an upcoming Arab summit in Qatar and intends to join future African summits. While Qatar has not signed up to the statute, if Bashir were to get away with visiting a country that has done so it might seriously challenge the court’s authority.

Putting Africa on trial?

Look down the list of the cases the International Criminal Court is pursuing – Congo, Central African Republic, Darfur, Uganda – and it doesn’t take long to spot the connection.

Of the dozen arrest warrants the court has issued, all have been against African rebels or officials. On Monday, the court begins its first trial - of Thomas Lubanga, accused of recruiting child soldiers to wage a gruesome ethnic war in northeastern Congo. Earlier this month, former Congolese rebel leader Jean-Pierre Bemba was in court for a decision on whether to confirm charges of ordering mass rape to terrorise civilians in the Central African Republic.

The judges are also deciding whether to indict their first head of state, Sudan’s President Omar Hassan al-Bashir, accused by the court’s prosecutor of instigating genocide and other war crimes in Darfur. All those being pursued by the prosecutor reject the accusations against them.

There is no doubt there were atrocities in all the conflicts in question - families, villages and countries scarred for ever by murders, rapes, mutilations, kidnappings and burnings.

The question is why the court is only targeting conflicts in Africa, which may have a higher proportion of troubles than other continents, but certainly has no monopoly on evil. Ongoing or recent conflicts elsewhere include Iraq, Afghanistan, Russia-Georgia, Israel-Palestinians and Sri Lanka among others.

"We have the feeling that this court is chasing Africa," Benin’s president, Thomas Boni Yayi, commented last year of the moves to prosecute Sudanese President Bashir. Boni Yayi is no maverick. He is the leader of a peaceful pro-Western country with a record of democracy as good as any on the continent.

One explanation for the ICC’s focus on Africa could be that justice systems on the continent are not in a position to pursue those accused of war crimes.

“The ICC is a court of last resort.  It will not act if a case is investigated or prosecuted by a national judicial system unless the national proceedings are not genuine, for example if formal proceedings were undertaken solely to shield a person from criminal responsibility,” the court says.

But it is far from clear that those who may have committed war crimes outside Africa are being pursued or could be pursued by local justice systems.

Another reason for putting so much weight on Africa might be that it is relatively easy and uncontroversial. Its states and rebel factions are not particularly influential. The conflicts in Africa are not at the heart of any global struggles that could result in major diplomatic ructions.

The risk for the court, though, might be a loss of credibility within the continent and beyond. The attempt by the court’s prosecutor to bring charges against President Bashir has certainly made some African states ponder whether it was sensible to sign up to and ratfiy the 2002 Rome statute that established the court.

African support has been significant. Of those that have become “States Parties”, 30 are from Africa. Compare that to the one (Jordan) in the Middle East. The United States has not signed up. Nor has China or Russia.

Is the court targeting Africa disproportionately or do its actions simply reflect a disproportionate number of war crimes committed there? What will it mean for the court’s credibility if it does not tackle atrocities elsewhere? Should we just be pleased that a start is being made to prosecuting those accused of war crimes, wherever they were committed?

Drugs and guns in Guinea-Bissau

Members of Guinea-Bissau’s unruly armed forces have blotted the military’s record again with another attack against the country’s political institutions. Early on Sunday, Nov. 23, renegade soldiers, their faces hooded, sprayed the Bissau residence of President Joao Bernardo “Nino” Vieira with machine-gun and rocket-propelled grenade fire. The president survived unhurt this latest apparent attempt to topple him.

 

But The attack underlined the fragility of the small, cashew nut-exporting West African nation, one of the poorest in the world and a former Portuguese colony which has suffered a history of bloody coups, mutinies and uprisings since it won independence in 1974 after a bush war led by Amilcar Cabral. The assault followed parliamentary elections on Nov. 16 which donors were hoping would restore stability and put in place a new government capable of resisting the serious threat posed by powerful Latin American cocaine-trafficking cartels who use Guinea-Bissau as a staging post to smuggle drugs to Europe.

 

How can a little-known African country like Guinea-Bissau, prostrated by poverty, its government and military undermined by the corrupting influence of multi-million dollar drug-trafficking, dig itself out of underdevelopment?

 

What should foreign donors do? Invest hundreds of millions of dollars to back security reforms to downsize and modernise the bloated army and struggling police and fund development programmes — even though aid workers say the government and state often appear barely functional and incapable of presenting or implementing programmes.

 

Or, at a time of global economic crisis when financial resources are stretched and Africa seems filled with conflicts, election disputes and refugees, (Congo, Darfur, Chad, Somalia, Zimbabwe), should the international community look for more deserving (or strategic) cases than little Guinea-Bissau?

How serious is Sudan’s Darfur ceasefire?

Sudan's President Omar Hassan al-Bashir was in a jubilant mood when he announced to crowds of supporters that he was declaring a ceasefire in Darfur.

From his body language, you might have thought he had already ended the crisis and achieved his goal of avoiding a possible indictment by the International Criminal Court for alleged war crimes in Darfur.

In the build-up to his speech, supporters surged to the front of the crowd waving sticks and punching the air with their fists to show their support for the army officer who came to power in Sudan in a coup in 1989. There was almost a party atmosphere.

Tanzania's foreign minister Bernard Kamillius Membe was greeted with cheers as he announced that Sudan had shown that African countries could look after their own crises.

"The International Criminal Court is an irrelevance," said the Tanzanian minister. "You are masters of your own destiny. Africa does not need outsiders to resolve its conflicts."

But after the celebrations were over, serious questions remained as to what impact the ceasefire and other new measures would have on the festering Darfur conflict and the ICC prosecutor’s hope of putting Bashir on trial.

Diplomats quickly spotted loopholes in the text of Bashir’s speech.

Bashir promised an "unconditional" ceasefire in Darfur but in the same sentence added that it would come into force "provided an effective monitoring mechanism be put into action and observed by all involved parties."

That amounted to "a pretty big caveat" given the difficulty of establishing ceasefire mechanisms in Darfur in the past, one diplomat told me, speaking on condition of anonymity.

Analysts also questioned why Bashir had not announced any freeing of political prisoners from Darfur, another of the recommendations of the government-backed forum that came up with the proposal to call a ceasefire.

Even some officials appeared sceptical.

“Peace in Darfur will not come until the two sides sit down together and agree the issue,” said one, who declined to be named.

Past ceasefires in Darfur have come and gone bringing little change for the estimated 2.5 million Darfuris driven from their homes by more than five years of fighting.

Will this one be any different, particularly since Darfur rebel groups have said they will continue to fight and have dismissed Bashir’s ceasefire as a public relations sham? What difference could it make in a region increasingly at the prey of bandits? Could it be enough to convince sceptical Western countries to agree to postpone any indictment of Bashir?

France and Darfur: Dirty deals over genocide or pragmatism for peace?

Sarkozy at U.N. General Assembly 

French President Nicolas Sarkozy announced that if Sudan changes its behavior and actively supports growing international calls for peace in Darfur, Paris would back suspending any indictments the International Criminal Court (ICC) issues against Sudanese President Omar Hassan al-Bashir.

Sarkozy made clear there would be strings attached.  In a speech to the U.N. General Assembly, the French leader said Sudan would have to “radically” alter its policy towards Darfur, where international experts say at least 200,000 people have died since 2003. It would have to remove a cabinet minister indicted for war crimes in Darfur from the Khartoum government and stop delaying the deployment of international peacekeepers.

Not everyone will laud Sarkozy’s comments on the opening day of the General Assembly.

The New York-based rights watchdog Human Rights Watch (HRW) has already chided the African Union Peace and Security Council for calling on world powers to use their power to put the ICC investigation of Bashir on hold to avoid undermining the stalled peace process in Darfur.

“A suspension of the investigation would deny justice to the thousands of victims in Darfur,” said Georgette Gagnon, HRW’s Africa director. “The African Union should reaffirm its commitment to seeing justice done for atrocities and support for the ICC in Darfur.”

According to Western diplomats whispering in the corridors of the United Nations, France is not the only western country that could imagine invoking Article 16 of the ICC statute, which allows the U.N. Security Council to suspend court investigations or indictments for up to one year at a time.  They say Britain may also be open to the idea, though London would have an even longer list of conditions - terms that Khartoum might find very unpalatable.

Some say Washington, which has refused to become a party to the ICC, could also be persuaded.

Privately, some Western diplomats have called the threat of a humiliating ICC prosecution of Bashir an ideal club to beat him over the head with as they try to get the full U.N.-African Union peacekeeping force on the ground in Darfur.  More than a year after the Security Council approved deploying the force, known as UNAMID, only around 10,000 of the 26,000 troops and police have arrived in Sudan.

None of this is good news for ICC chief prosecutor Luis Moreno-Ocampo, who has run into snags with another case and has come under fire for his retaliatory dismissal of an ICC employee. Moreno-Ocampo is currently in New York meeting with African and other officials to defend his drive to indict Bashir, whom he accuses of masterminding a campaign of genocide in western Sudan.

He says Bashir’s war crimes began in 2003 and that his orders led to the deaths of 35,000 people outright, at least another 100,000 through starvation and disease and forced 2.5 million from their homes.

Bashir’s challenge to the ICC - can the court respond?

bashir-in-istanbul.jpgInternational prosecutors’ pursuit of Sudan’s President Omar Hassan al-Bashir for alleged genocide has not curtailed his travel schedule. He is in Turkey this week, defiant and saying the move by the International Criminal Court has backfired — his hold on power is stronger than ever.

Bashir gave an exclusive interview to Reuters, his first since ICC Chief Prosecutor Luis Moreno-Ocampo said he was seeking a warrant for his arrest.

Here are excerpts from the conversation with Reuters:

“The decision of the ICC prosecutor is already soldifying our internal front, the internal front of our Sudanese people, and that is the source of our power and we will fight their
actions.”

“…we don’t give a damn about the precedents set by those going to court.”

“We are not concerned about travelling, ourselves, we have good relations with a number of countries that do not have relations with the ICC.”

Does Bashir’s trip to Turkey (which isn’t a signatory to the ICC) show him to be above the law? How can the ICC respond, with no police force of its own to enforce its rulings even if it does issue a warrant for Bashir’s arrest?

African and Arab states want the court moves put on hold, fearing they would only make it harder to bring peace to Darfur. Oil producing Sudan’s close ally China has also voiced concern at the attempt to put Bashir on trial.

Can the ICC prosecutor prevail?
